Acceptance of Terms

By accessing or using Whittl™ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

Whittl is a decision-making application that allows users to create sessions with multiple options, vote on those options, and determine winners through an elimination process. The Service may be used individually or collaboratively with others.

Use of the Service

You agree to use the Service only for lawful purposes. You agree not to:

Use the Service for any illegal or unauthorized purpose
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any part of the Service
Use the Service to harass, abuse, or harm others
Submit content that is offensive, defamatory, or violates the rights of others

User Content

You are responsible for the content you submit to the Service, including session options and any other materials. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

The Service, including its design, features, and functionality, is owned by Whittl and is protected by copyright, trademark, and other intellectual property laws.

Whittl™ and the Whittl logo are trademarks of Whittl. All rights reserved. The Whittl name, brand, and associated visual identity are proprietary to Whittl and may not be used without prior written permission. Unauthorized use of the Whittl trademarks, including the name, logo, or any confusingly similar marks, is strictly prohibited.

Nothing in these Terms grants you any right, title, or interest in the Whittl trademarks or intellectual property, except for the limited right to use the Service as permitted herein.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITTL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Termination
